Information We Collect

The Site captures some information about you automatically utilizing background local storage and session storage technologies for user information and internal authentication purposes. Examples of information of this type are your IP address, the browser you are using, the operating system you are using and the pages on the Site that you visit. We may also collect information from publicly available sources.

The Site also collects information that you provide to us voluntarily when you request information, register with the Site, apply to be a Host and/or sign up to be a Guest or attend an event. You will be asked to provide certain information about yourself including, without limitation, your name, physical address, e-mail address and related information, phone number, interests and preferences, causes that interest you, activity interests and preferences and demographic information. If you sign up to be a Host or a Guest, some of your personal information will be shared with other users of the Site. Please see the section “With whom we may share the information” below for more information.

Please do not submit to us any sensitive personal information.

Some of our services are fee-based services. If you choose to use our fee-based services, you will need to provide, in addition, payment card information in order to process your payment.

We do not knowingly collect information from persons under the age of 13 and/or their internet usage, and such persons are not authorized to use the Site. If we obtain actual knowledge that a user is under 13, we will take steps to remove that user’s personal information from our databases. By using the Site, you are representing that you are at least 13 years old. You also represent, by accessing or using the Site, that you are of legal age to enter into legal agreements, or if you are not, that you have obtained your parent’s or legal guardian’s consent to accept the terms in this Privacy Policy.

How We Use the Information

We use the information we collect to provide or enhance the services you request, connect Hosts and their Guests and vice versa, provide updates and other important information related to your activity on the Site, inform you of new services or changes in services, and administer the Site. You will have the opportunity to opt out of any electronic marketing communications you may receive from us.

With Whom We Share Information

When you apply to become a Host you will submit certain personal information to us to complete your application.  If you are approved and become a Host, the personal information you provide in your experience listing will be publicly available on our Site for viewing.  In addition, your contact information will be shared with the Guests who purchase the experience.

When you register as a Guest, the personal information that is shared with the Host depends on the type of experience and information about you that is necessary to process your request. Hosts are contractually required to use Guest personal information solely to fulfill the experience and administer related requests.

Hosts and Guests also have the opportunity to communicate with each other one-to-one via our Site in connection with the purchase, scheduling and participation in experiences.

We also provide personal information to SameSide’s third party providers, such as our credit card processor and our website developers. We rely on a payment card processing company to assist us in processing and managing payment transactions. SameSide assumes no liability for the security or application of these services if you choose to use them. We do not store sensitive payment data such as credit card number, expiration date, or CVC. Rather, we pass the payment data to the third-party processor.

We may disclose information if we have a good faith belief that disclosure is necessary by law or the legal process, to protect and defend our or others’ interests or property, or to enforce agreements you enter into with us. Your information may be transferred to another company in connection with a merger or in the event that our business is acquired in whole or part by another company.

We may share aggregated and de-identified information with third parties for analytical, research or other similar purposes.

SameSide may obtain your written consent from time to time in electronic form by using online agreements or other acknowledgements on the Site. Please read all online agreements carefully before accepting them.

Your Choices

Our Site enables you to maintain a profile where you may access and edit your personal information. You may also request that your account be deleted by contacting us at info@onsameside.com.

You may opt out of receiving electronic marketing communications from us by clicking on the “unsubscribe” link on the communication.

Some non-marketing communications are not subject to a general opt-out, such as communications about sales transactions, experience updates and information, disclosures to comply with legal requirements, software updates and other support-related information.

Security Procedures

We take reasonable precautions to protect your passwords, the personally identifiable information you provide to us, and communications between us.   Because no Internet or e-mail transmission is ever fully secure or error free, please be careful in deciding what information you send to us via email or over the Internet. We cannot guarantee absolute security and users assume the risk of security breaches and all consequences resulting from them. To assist with the protection of personally identifiable information, you must keep your account information confidential and not disclose it to any other person. You are responsible for all uses of the Site by any person using your account. Please advise us immediately if you believe your account has been misused. How to Correct Information

California Disclosures

California Information-Sharing Disclosure: California residents may request a list of all third parties with respect to which we have disclosed any information about you for direct marketing purposes and the categories of information disclosed. If you are a California resident and want such a list, please send us a written request by email to info@onsameside.com with “California Privacy Rights” in the subject line.

California Do Not Track Disclosure: We do not respond to Do Not Track browser settings.

Jurisdiction

SameSide is a Delaware limited liability company. If you are an individual from the European Union, Canada or any other jurisdiction with laws or regulations governing personal data collection, use, and disclosure that differ from United States laws, please be advised that through your use of the Site, which is governed by California law, this Privacy Policy, and our Terms of Use, you are transferring your personal information to the United States, and you expressly consent to that transfer and consent to be governed by California law for these purposes.

Governing Law; Dispute Resolution

Any disputes regarding this Privacy Policy will be governed by the laws of the United States and by the laws of the State of California excluding: (1) its conflicts of law principles; and (2) the United Nations Convention on Contracts for the International Sale of Goods. Any dispute arising hereunder or relating hereto shall be resolved by binding arbitration in Los Angeles, California. Any arbitration between you and SameSide will be governed by the Commercial Dispute Resolution Procedures and the Supplementary Procedures for Consumer Related Disputes (collectively, “AAA Rules”) of the American Arbitration Association (“AAA”), as modified by these Terms of Use, and will be administered by the AAA.

Privacy Policy Changes

We may update this Privacy Policy from time to time and without prior notice to you to reflect changes in our information practices, and any such amendments shall apply to information already collected and to be collected. Your continued use of our Site after any changes to our Privacy Policy indicates your agreement with the terms of the revised Privacy Policy. Please review this Privacy Policy periodically and especially before you provide personally identifiable information to us. If we make material changes to this Privacy Policy, we will notify you here, by email or by means of a notice on our home page.
